Terms of use

Licence grant

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use MobiObs on devices you own or control, within the limits of your tier:

• Free: one device.
• Pro: one user, on up to three devices.
• Team: the number of seats purchased by your organisation.

MobiObs is licensed, not sold. We and our licensors retain all rights not expressly granted.

Restrictions

You must not:

• copy, modify, distribute, sell, rent or sublicense MobiObs, except as permitted by law;
• reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits this despite this restriction;
• remove or circumvent the licensing or entitlement checks, or generate, share or publish licence keys;
• use MobiObs to build a competing product, or offer it as a hosted service to third parties.

Lawful and authorised use

MobiObs receives and stores data sent from network equipment, and it can generate network traffic. You may use it only lawfully, and only on networks and equipment that you own or are authorised to monitor and test.

• You are responsible for obtaining any permission required before you point equipment at MobiObs, collect logs, flows or traps, or use Sender or Replay to transmit traffic.
• Collected data may contain personal data such as IP addresses and user names. You are responsible for handling it in line with the laws and policies that apply to you.
• You must not use Sender or Replay to disrupt, flood or attack any system.

Subscriptions, purchases and refunds

• Purchases made through Google Play or the Apple App Store are billed by that store. Renewal, cancellation and refunds are handled under the store's policies. Manage or cancel a subscription in your store account settings.
• For licence keys bought directly from us, the refund terms shown at checkout apply.
• If a paid entitlement expires or is cancelled, MobiObs continues to work on the Free tier. Retention and other limits then apply, but data is never deleted immediately, and a running capture is not interrupted.
• We may change prices or tier features for future purchases. Changes do not affect a period you have already paid for.

Licence keys

• A licence key is issued to the named licensee and is non-transferable.
• Team: the organisation may reassign seats between its own users, for example when someone leaves. Contact sales@mobiobs.com to reassign a seat.
• Keep your key confidential. We may revoke a key that has been shared publicly or obtained fraudulently.
• After a time-limited key expires, it keeps working for a grace period stated in the app, and then MobiObs reverts to the Free tier.

Your data

Data collected by MobiObs stays on your device, and you own it, as far as it is yours to own. We do not receive it. Our privacy policy explains the limited data we do process.

Updates and support

We may release updates that add, change or remove features. We provide support by email at support@mobiobs.com on a reasonable-efforts basis, unless a separate written agreement says otherwise.

No warranty

To the maximum extent permitted by law, MobiObs is provided "as is" and "as available", without warranties of any kind, express or implied. This includes warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

Network telemetry is by nature incomplete. UDP traffic can be lost, and equipment, operating systems and networks can drop or delay packets. We do not warrant that MobiObs will receive, decode or keep every message, and it is not intended as the only record for compliance, safety-critical or life-critical purposes.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or business, arising from your use of or inability to use MobiObs.

Our total liability for all claims relating to MobiObs is limited to the amount you paid for MobiObs in the twelve months before the claim, or, if you paid nothing, to the equivalent of 50 US dollars.

Nothing in these terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, or for fraud, and nothing in these terms affects your statutory rights as a consumer.

Termination

This licence ends automatically if you breach these terms. You can end it at any time by uninstalling MobiObs. The sections on restrictions, lawful use, no warranty, limitation of liability and governing law survive termination.

Governing law

These terms are governed by the laws of the jurisdiction in which the MobiObs operator is established. The courts of that jurisdiction have jurisdiction over disputes, unless mandatory consumer protection law gives you the right to bring proceedings where you live.

Changes and contact

We may update these terms. The effective date above shows when they last changed. If you keep using MobiObs after a change takes effect, you accept the updated terms.
